PUTRAJAYA — May 13, 2019: PKR vice-president Mohd. Rafizi Ramli has won his appeal against a high court order for him to pay RM200,000 in damages to National Feedlot Corporation (NFCorp) executive chairman Datuk Seri Dr. Mohamad Salleh Ismail and his company for defamation.
The Court of Appeal comprising Datuk Hamid Sultan Abu Backer, Datuk Hanipah Farikullah and Datuk Wira Kamaludin Md. Said allowed the appeal unanimously and with costs.
Thus Justice Hamid Sultan ordered Salleh to refund RM300,000, which includes the RM200,000 in damages and RM100,000 costs, within 30 days, failing which a five per cent per annum interest will be imposed until payment is settled.
He also ordered Salleh to pay RM10,000 costs for the appeal proceedings and the RM100,000 for proceedings in the high court.
The court dismissed a cross-appeal by Mohamad Salleh on the quantum of damages.
In 2013, Salleh and NFCorp sued Rafizi claiming that he had made a defamatory statement in March 2012 at a media conference on the purchase of some properties which was published by Malaysiakini the same day.
On October 31, 2016, a high court ordered Rafizi to pay RM150,000 in damages to Salleh and RM50,000 in damages to NFCorp. Rafizi was also ordered to pay RM100,000 costs to Salleh but dismissed the latter’s suit against Malaysiakini. — Bernama
