Najib loses bid to strike out 1MDB report tampering charge

KUALA LUMPUR — Aug. 14, 2020: The High Court today dismissed an application by former prime minister Datuk Seri Najib Razak to strike out a charge over his alleged role in the tampering of the 1Malaysia Development Berhad 2016 audit report.

In reaching the decision, Justice Mohamed Zaini Mazlan ruled that the grounds submitted by Najib had failed to meet the standards required to grant a dismissal. 

He remarked that an application to set aside or quash a charge should only be allowed in the rarest of circumstances where there could be a miscarriage of justice. 

“The grounds submitted by the applicant, as convincing as he thinks they are, should only be considered at the end of the prosecution’s case, for it would be premature for the court to consider them at this stage without availing itself of all the evidence that the prosecution will submit,” he said.
