KOTA KINABALU — May 17, 2018: Sabah Barisan Nasional chairman Tan Sri Musa Aman today filed a writ of summons against Yang Dipertua Negeri Tun Juhar Mahiruddin and Parti Warisan Sabah president Datuk Seri Shafie Apdal to seek a declaration that he (Musa) remains the lawful chief minister of Sabah.
The writ also seeks a declaration that the swearing in of Shafie as chief minister was unconstitutional.
It also seeks a declaration that any and all acts by Shafie whilst purporting to be the chief minister are null, void and of no effect.
The writ was filed by Messrs F.T. Ahmad & Co. and named Tun Juhar and Shafie as the first and second respondents respectively.
Under the Rules of Court 2012, once the writ is served, both Juhar and Shafie have 14 days to enter an appearance.
Musa was sworn in as chief minister on May 10 and Shafie on May 12. — Bernama
