Bersih head fails to challenge travel ban

KUALA LUMPUR — May 18, 2017: The High Court today dismissed a judicial review application by Bersih 2.0 chairperson Maria Chin Abdullah to challenge the Immigration director-general’s decision to bar her from travelling abroad.

Justice Datuk Nik Hasmat Nik Mohamad ruled that the application had become academic in nature and that the decisions by the DG and home minister were not reviewable.

The judge further pointed out that while the application was being heard in court, the ban was lifted on May 17 last year.

Nik Hasmat said it was clear that under Section 59A of the Immigration Act, there shall not be any judicial review of a decision by the DG or home minister except for procedural non-compliance.

In her application on July 28 last year, Maria said she was informed of the ban shortly before she was to board a flight to South Korea at the KL International Airport. — Bernama
